Safety sheets label these chemicals as corrosive and dangerous, and warn that contact can cause sever chemical burns and permanent damage to tissues.  They recommend wearing full protective clothing, gloves, and eye protection to those who handle the chemicals. Many of these compounds have a high pH (over 10) which is hazardously corrosive. The implications to the creek health could be catastrophic.

Time Line:

Ergon Asphalt and Emulsions Inc. has submitted a permit application to the Texas Commission on Environmental Quality (TCEQ) for the release of up to 133,000 gallons of waste water and boiler blow down into Wilbarger Creek each day from their new asphalt facility on Old Highway 20 in Manor.

According to the application submitted to the TCEQ, Ergon intends to add over 10 gallons of chemical cocktails to the boilers weekly. This discharge will run through a man-made channel, to Wilbarger Creek, and ultimately the Colorado River.  

Ergon Asphalt and Emulsions has a record of faulty operations- a contamination by their Corpus Christi facility forced the city to instigate a four-day water ban. We are concerned about their commitment to maintaining safety procedures and complying with regulations. 

The pollutant analysis submitted by Ergon with the application to the TCEQ is incomplete and noted that fully analysis would be conducted after the permit was granted. A few of the chemicals mentioned are:
